September 1, 2016 Regular News Bar board considers time standards for email service Bar board considers time standards for email service Saying they are concerned about manipulations by unscrupulous lawyers, the Bar Board of Governors has tabled consideration of rule amendments that remove an extra five days to respond to documents served by email. The board, at its July 29 meeting, considered a variety of amendments to Civil Procedure Rules, as well as the Rules of Judicial Administration, and Appellate Court Rules relating to the service of documents. The civil rules merely corrected references to the Rules of Judicial Administration dealing with service times, and the board recommended those be approved by the Supreme Court by a 41-1 vote. But board members objected to two amendments to the Rules of Judicial Administration, 2.514 and 2.516, and one appellate rule, 9.420. The Rule 2.514 amendment removes email service from a subdivision that allowed five additional days for responding to service by regular U.S. mail. The Rule 2.516 amendment removed email from a section that said email service would be treated as service via U.S. mail for time computation purposes — which adds five days to those allowable times. Rule 9.420 specified that service by email in appellate matters be treated as service by U.S. mail for time computations and exempted appellate service from the time reductions in the RJA amendments. Judson Cohen, vice chair of the RJA Committee, said the extra five days allowed for email service, which was passed a few years ago, was always intended to be temporary and to be eliminated as lawyers got used to switching from paper to electronic court documents. It was done, he said, because the shift from paper to electronic service was “mind-bending” and the committee wanted to give lawyers time to adjust. Giving them in essence an extra five days to respond to served documents was seen as a way to ease that transition. Under the amendments, email service would be treated the same as electronic service through the court’s statewide e-filing portal, fax, or hand delivery, Cohen said. Appellate Court Rules Committee Chair Kristen Norse said the appellate rule amendment exempted appellate rules from the RJA amendments because appellate practice is different from other practices, and the committee felt the extra time was needed. Board members expressed two main concerns. One was that the time periods would be different in different rules. The second was the loss of the extra five days with email service might hurt practitioners if their opponents timed delivery for an inconvenient time, say 11:59 p.m. on a Friday night. “I don’t care whether we add five or take away five days. Whichever way you go, you should be consistent,” President-elect Mike Higer said. “Here, we’re making it more difficult for our practitioners.” Cohen said the RJAC discussed attorneys trying to game the rules by timing their service to inconvenience their opponents, but said in those cases lawyers always had the option of seeking relief from the court. But board members said that might not always be practical. “It’s great to say you can seek relief from the court, but frequently I can’t get a hearing in the time I need one,” said board member Bruce Robinson. “I don’t want to have two sets of standards. I want life simpler for our lawyers, not more complex.” Other board members agreed, and the board eventually voted to table the three amendments to get more input, including from the Trial Lawyers Section.
The Centers for Disease Control and Prevention (CDC) published five case studies today in Morbidity and Mortality Weekly Report (MMWR) of patients who experienced serious complications and bacterial infections after receiving treatments for “chronic Lyme” disease.There is no medical definition of “chronic Lyme” and no treatment guidelines; instead, the term is used by patients and some providers to describe several symptoms, including fatigue and muscular pain, attributed to prior infection with Lyme disease. Many patients with a chronic Lyme diagnosis, however, test negative for Borrelia burgdorferi, the bacteria associated with the ticks that carry Lyme.Some practitioners, including alternative medicine professionals who advertise themselves as being “Lyme literate” prescribe long-term courses of antibiotics and immunoglobulin therapy. But the CDC warns that treating an undiagnosed condition with an unregulated treatment plan can be dangerous for patients.”At least five randomized, placebo-controlled studies have shown that prolonged courses of IV [intravenous] antibiotics in particular do not substantially improve long-term outcome for patients with a diagnosis of chronic Lyme disease and can result in serious harm, including death,” the authors write.Poor patient outcomesTo describe the threats of over-treating the undiagnosed condition, the CDC published five patient descriptions that come from state health departments. In one case, a woman died from shock after she received a peripherally inserted central catheter (PICC) for IV antibiotic treatment for persistent Lyme. Her joint pain never resolved after 3 weeks of treatments, and she eventually died from central venous catheter–associated bacteremia.Another patient, a teen girl, also got septic shock after her PICC became contaminated. She had been seeing an alternative health practitioner who prescribed long-term use of ceftriaxone. Her PICC was removed, but she was hospitalized for weeks.Another patient, a 50-year-old woman, sought treatment for chronic Lyme for 5 years. She developed Clostridium difficile colitis as a result of using several antibiotic, antifungal, and herbal remedies.”The C. difficile infection became intractable, and her symptoms persisted for over 2 years, requiring prolonged treatment. The patient subsequently died from complications of amyotrophic lateral sclerosis,” the authors write.Concern over resistance, other complicationsAccording to the CDC, it is not known how many people seek treatment for chronic Lyme, or how many complications occur during the course of treatment.”In addition to the dangers associated with inappropriate antibiotic use, such as selection of antibiotic-resistant bacteria, these treatments can lead to injuries related to unnecessary procedures, bacteremia and resulting metastatic infection, venous thromboses, and missed opportunities to diagnose and treat the actual underlying cause of the patient’s symptoms,” the authors conclude.See also:Jun 16 MMWR report

There’s no shortage of talent nor ambition when it comes to Dalton Coker’s budding singing career. The 16-year old from Jacksboro is working his way toward his big break with plenty of enthusiasm. Two years ago as an eighth grader, Coker auditioned in Nashville for The Voice. Yesterday afternoon at Knoxville he auditioned for America’s Got Talent.He arrived at the Knoxville Convention Center around 8:30 am Thursday morning. He auditioned around 2 pm.The upside is his almost seven hour wait to sing his version of Sam Smith’s “Lay Me Down” is over. The downside is his wait to learn if he made the cut is four months away.He told WLAF that, “If you play your own instrument, you can have music with your song. If you don’t you, must sing a cappella.” He sang a cappella.The Campbell County High sophomore has been singing since he was five. He credited his elementary school music teacher John Edwards as one of his early influences. The Children’s Band and the Wiggles played a role in getting him more interested in singing, Coker said with a laugh.Coker sings all genres from rap to rock and doesn’t have a favorite singer. But some of those he said, were “up there” are Nathan Sharp, Sam Smith, Cyndi Lauper and Ed Sheeran.His plans range from a singing career to moving to New York City and auditioning on Broadway or perhaps going on to college and majoring in voice.The WLAF staff hopes Coker will perform a number of Christmas songs on air this holiday season. The white pants are perfect for them, in my book. I think the color balance is much better with the white pants than the grays – there’s no other gray elements in their uniform, other than the facemask, which is practically a default option for facemasks for old-line NFL teams in this day and age. Having gray pants with a uniform that barely features gray otherwise is a bit off-balance. We had one outstanding match up, some really good looking match ups, and a couple not so great match ups. As always, the lists are just my opinion. Case in point, I feel like Jets/49ers is made even better by the Jets green pants because there’s just the right amount of green to contrast with the red and gold. All-white still looks great, don’t get me wrong, I just like the green pants in this matchup even better because they make the matchup a little more interesting. Bears/Lions is another one where the Bears’ navy pants provide a nice dark vs. light tonal matchup (plus, I think Chicago’s navy-white-navy-white combo is one of the best road looks in the whole league anyways).
